I'm  live in West Tejas, but I'm NOT a redneck!  if you don't like that, big deal!  I own GUNS and Rottweillers!   I'm a Vietnam Combat Veteran of the 11th Armored Cavalry Regt.  And FWIW......I'm not impressed by a whole lot of people I meet on the Internet!  I'm also a PK.

My question is also about the BlueHost subpoena.  Or are you following that one?

It might be better to avoid calling me "Atty." since I am not one, and since Danny Shelton more than one year ago accused me on a globally televised broadcast of posing as a doctor. We should avoid wherever possible of giving him the smallest grounds for what I believe are baseless accusations.

In answer to Snoopy's questions, BlueHost did comply. Subpoenas must be signed by the court clerk, or by an attorney who can sign as an officer of the court, according to Federal Rule of Civil Procedure 45(a)(3):

Quote
(3) Issued by Whom.

The clerk must issue a subpoena, signed but otherwise in blank, to a party who requests it. That party must complete it before service. An attorney also may issue and sign a subpoena as an officer of:

(A) a court in which the attorney is authorized to practice; or

(B) a court for a district where a deposition is to be taken or production is to be made, if the attorney is authorized to practice in the court where the action is pending.

So, BlueHost complied with an invalid subpeona?    Hhmm.  Is is safe to draw a conclusion from that about the competency of their legal department and their loyalty to their customers?  I even tried to draw their attention to it in an email I sent to abuse@bluehost.com on March 14:


"I've also reviewed the subpoena you received for the AdventTalk website and am curious as to the absence of a referenced case # for the underlying lawsuit.  I find no record of that lawsuit in the U.S. District Court of Utah between the parties named on your subpoena."


I guess I'm not impressed!!

No webhost is perfect. I've used other ones, and personally, I wouldn't want to trade, even though I think they made a mistake on this one.

And, it's a sad day when we can't even joke, but yes. Each needs to be wary that DS/3abn are not given any material that can be taken out of context and quoted as fact. Rather amazing the way things can be changed to reflect what people WANT to use against a person, rather than using it in the same context that it was originally used/intended. :o

 :)  Kevlar is a fibre created by DuPont.  It is used to make body armor and peaceful items like car break shoes, tires,  roofing, drum heads, stereo speakers, and boat hulls.

I received a letter from Attorney Hayes yesterday. She has withdrawn the subpoena to Calvin and has given us 10-business-day notice prior to again issuing a subpoena on April 7.

This applies to Black SDA and not to Advent Talk. . . AT is under the Subpoena?
